Doesn't it if something gets a thing out of it? Say, joy? I'd say no. The malicious act itself is likely not the thing which is eliciting joy. Rather, a deficiency in the thing itself is in some way being supplemented through the act. Thus the thing performing the act may just as easily obtain joy (or whatever its deficiency is) in another way which may not be harmful to someone or something else. For example, it is common for people with a psychological insecurity or lack of control to use or abuse other people in an attempt to satisfy the need for control over their own lives. They are not doing it to hurt someone else. They're doing it to help themselves. It just so happens that the method they are using is doing damage to another entity in the process. In fact, the negative consequences of such behavior often lead to more emotional problems which in turn cause the aggressor to attempt to gain even more control by committing similar acts. So these malicious acts can be said to be ultimately ineffective in their purpose. All of this suggests that the process is a sickness or dysfunction rather than actually "evil." But let's just say as a thought experiment that it wasn't supplanting anything else, it was just that evil for the sake of evil brought this person place or thing inexplicable glee. Let's say it was the abstract embodiment of evil for the sake of itself.

So if I ever saw it, I'd (for the first time) be inclined to ponder the existence of a god...a very mean and psychotic one.

But what if such a thing already did exist and because you are a human who clings to logical necessity and justification of actions, you mispercieved it?
